ORDER :
The following Notification will be published in the Tamil Nadu Government
Gazettee .
NOTIFICATION.
WHEREAS, the rights of practitioners of Indian System of Medicine are
protected under section 17(3) (b) of the Indian Medicine Central Council Act, 1970
(Central Act 48 of 1970) ;
AND WHEREAS, as per section 2 (1) (e) of the said Act, “Indian Medicine“
means the system of Indian Medicine commonly known as Ashtang Ayurveda, Siddha
or Unani Tibb whether supplemented or not by such modern advances, as the Central
Council of Indian Medicine may declare by notification from time to time ;
AND WHEREAS , the Central Council of Indian Medicine in its Notification
F.No.28-5/2004-AY.(MM), dated the 19th May 2004, has clarified that the word “Modern
Advances” in clause (e) of section 2 (1) of the said Act as advances made in the
various branches of modern scientific medicine in all its branches of internal
medicine , surgery, gynaecology and obstetrics , anesthesiology, diagnostic procedures
and other technological innovation made from time to time and declare that the courses
and curriculum conducted and recognized by the Central Council of Indian Medicine are
supplemented with such modern advances ;
AND WHEREAS , the Central Council of Indian Medicine has improved and
strengthened the syllabus of Indian Medicine by including subjects with regard to
National Programmes like National Malaria Eradication programmes, Tuberculosis,
Leprosy, Family Welfare Programme, Reproductive and Child Health Programme,
Immunisation Programme, AIDS, Cancer etc ;

Now, THEREFORE, under sub - clause (iii) of clause (ee) of rule 2 of the Drugs
and Cosmetics Rules, 1945 the Governor of Tamil Nadu hereby declares every
registered medical practitioner holding the qualifications specified in the second, third
or fourth Schedule to the Indian Medicine Central Council Act, 1970 (Central Act
48 of 1970) and Part III of the Schedule to the Tamil Nadu Siddha System of Medicine
(Development and Registration of Practitioners) Act , 1997 (Tamil Nadu Act 34 of 1997)
and registered in the Medical Register of the State maintained under the aforesaid
Acts, as a person practicing the modern scientific system of medicine for the purposes
of the Drugs and Cosmetics Act, 1940 (Central Act 23 of 1940.)

Directorate of Medical and Rural Health Services – Rationalisation of posts of doctor – Creation of additional posts of Assistant Surgeon – Revision of method of counselling

The salient points of the GO are

7. The Government have examined the proposal of the Director of Medical and Rural Health Services and the Project Director, Tamil Nadu Health Systems Project in detail and decided to accept the proposal subject to certain modifications.
8. (a) Accordingly the Government
(i) sanction 434 additional posts of Assistant Surgeon in the scale of pay of Rs.15600 - 39100 + G.P. Rs.5400 for a period of one year from the date of issue of Government Order at an estimated recurring
expenditure of Rs.21.99 crores per annum to meet the requirements in the current round of rationalisation of Director of Medical and Rural Health Services run hospitals in the State as a whole; and
(ii) notify all posts of Assistant Surgeon in Government Hospitals under
the control of Director of Medical and Rural Health Services, the
posts proposed to be sanctioned and the posts already sanctioned
under Tamil Nadu Health System Project as that of specific specialist
post or MBBS post.
(b) The Government also direct that
(i) the doctors with Diplomate of National Board (Dip. NB) qualification be considered as equivalent to Post graduate degree in the respective speciality;
(ii) the deputation of specialists working on Foreign service in dispensaries such as TNEB, Central Prison, Rehabilitation Home, Juvenile Home, Police Hospital etc., and ESI Dispensaries be revoked and all dispensary category posts be notified as MBBS posts and all posts in Government dispensaries and Mobile Medical Units be designated as MBBS posts;
(iii) all posts in Primary Health Centres be designated as MBBS posts with only upgraded Primary Health Centres to have one post that is designated as a DGO/Female MBBS doctor post wherein a DGO or a
Female MBBS Doctor be permitted to occupy the post subject to the condition that the MBBS posts shall not be filled up with specialists, unless that speciality has a surplus strength at the State level;
(iv) the process of earmarking of posts, identifying doctors in Government Hospitals speciality wise, as detailed in the Annexure-I & II (speciality-wise designation of posts in Government
Dispensaries, TB Centres and other institutions under the control of the Director of Medical and Rural Health Services) and Annexure-III (Designation of posts for foreign service institutions) to this order, counselling sessions and postings have to be completed first and the recruitment process be commenced only after that in a serial order and not parallely;

(v) the posts sanctioned under Tamil Nadu Health Systems Project be included as part of the overall sanctioned strength and
(vi) doctors having Postgraduate diploma qualification be transferred to the Director of Medical Education controlled Medical College and Hospitals only against the existing vacancy in their specialities until a doctor with Postgraduate degree qualification is found and posted accordingly.
(c) The Government approve the following counselling methodology in filling-up of both MBBS and specialists posts:-
i) At the initial stage, the posts earmarked for particular specialists will be informed hospital-wise publicly in the department and on a web-site so as to ensure that all doctors in the department are properly informed.
ii) In the first phase, the available specialists in each Government Hospital, depending on their willingness, will be accommodated according to station seniority in the sanctioned speciality posts of that institution.
iii) Then, a list of persons for whom sanctioned speciality posts are not available in their current / present working station will be prepared by the Director of Medical and Rural Health Services. Simultaneously, a list of vacant positions in each hospital will be prepared and notified on the website and in the Joint Director's office throughout the State. The list shall also be displayed in the Director of Medical and Rural Health
Services office. The list shall be displayed on the website as well.
iv) Following these preparatory steps, speciality-wise counseling based on service seniority at the state level will be carried out. In this phase, Civil Medical List seniority for those applicable and date of joining in service for others shall be the determining factor for being posted into an existing vacancy.
(d) The Government also approve
(i) the filling up of all vacancies that arise out of the proposed counselling immediately through Employment Exchange under rule 10(a)(i) in consultation with the Tamilnadu Public Service Commission and
(ii) the filling up of all Senior Civil Surgeon posts (including Dental Senior Civil Surgeon) with persons in the same speciality of a lesser rank in the event of non-availability of Senior Civil Surgeons till suitable persons become available from subsequent panels.
(e) The orders issued in the Government Order second read above, prescribing minimum three years of rural service for the candidates selected by the Tamilnadu Public Service Commission for the post of Assistant Surgeon in Tamil Nadu Medical Services as compulsory are hereby cancelled. The Director of Public Health and Preventive Medicine is directed to send suitable proposal to Government to delete the relevant rule from the Special Rules for the post of Assistant Surgeon.
(f) In supersession of the orders issued in the Government order first read above, the Government impose ban on diversion and re-deployment of specialists to institutions other than to which they have been posted to, with immediate effect unless there is a vacancy that is affecting the medical services of another institution as
compared to the institution from which a person is to be diverted.
(g) The Pay and Accounts Officers, Treasury Officers are directed to honour the Pay bills only if the doctors with the prescribed qualification for the sanctioned posts are posted in the respective posts by incorporating in the pay bill a certificate by the Pay Drawing Officer as prescribed by the Director of Treasuries and Accounts.

ORDER :
The Tamil Nadu Government Doctors Association has represented that theMedical Officers may be allowed to avail 2nd Saturday of the month as a holiday aswas being allowed till recently.

2) The Government after careful examination have decided to accept therequest mentioned in para above. Accordingly, they direct that the Medical Officerswho are required to perform duty on the 2nd Saturday of the Month in the normalroster, be entitled for compensatory leave, in lieu of the duty performed, subject to the
following conditions:-
i) that this compensatory leave should be availed in such a way that the normalwork in this hospital is not affected ;
ii) that the compensatory leave shall be availed only after advance permissionfrom the Medical Officer in charge/Superintendent or Dean of the Hospital andiii) that no additional staff shall be sanctioned to provide the above facility.
3) The total number of compensatory holidays is restricted to 20 days for awhole year on account of second Saturdays and Public Holidays and this will be takenat the rate of 10 days in each half year.

ORDER :

In the Government order first read above, the Government have issued guide-lines for conductiong counseling for transfer and promotion to the personnel working in the Health Departments. The Heads of Departments have reported that they are facing certain practical difficulties while conducting counseling and suggested certain modifications to the guidelines , for effective and fair administraton.

2. The Government have examined the suggestions of the heads of departments in detail and decided to issue certain modifications to the guidelines issued in the Government Order first read above.

4. In partial modifications of the orders issued in the said Government Order first read avove, the Government issue the following guidelines:-

(i) Counselling for transfer within the Directorate be held once in 3 months : during January, April, July and October.

(ii) Counselling for transfer inter-Directorate be held once in a year during March.

(iii) In a District where there is 15% and above of the total sanctioned strength of medical Officer/Para medical staff in the Medical Instittions under the control of Director of Medical and Rural Health Services, are vacant, the Medical officers/para medical staff from that district are not eligible to take part in counseling till the vacancy position in that district improves.

(iv) 75% of the total sanctioned post in a particular medical institution under the control of DME/DMS should not be kept vacant.

(v) In the case of Primary Health Centre, in a District where there is 10% and above of the total post of medical officers/para medical staff are vacant, the medical officers/para medical staff from that district are not eligible to take part in counseling.

(vi) Further, in the case of PHC, where there are only 2 sanctioned posts of Medical Officers, atleast one Medical officer should be available and in the case of PHCs where there are 3 sanctioned posts of Medical officers, minimum 2 Medical officers should be available. Wherever there are no lady doctors available in a Primary Health Centre, vacancies in such Primary Health Centre shall be reserved for Women.

(vii) Medical Officers/Staff who were transferred and not joined but went on long leave should not be entertained for counseling.

(viii) Medical Officers/other para medical staff who have been transferred on disciplinary grounds be declared not eligible for counseling till the disciplinary case is over.

(ix) Lady Medical Officers recently appointed through Tamil Nadu Public Service Commission and the Medical Officers appointed in PHC through Employment Exchange recently should not be considered for counseling till they have completed one year or till April 2003 whichever is later.

(x) No transfer should be effected in-between the counseling periods, other than those required on administrative grounds based on allegations and charges, which should be recorded in writing.

(xi) Director of Public Health and Preventive Medicine and Director of Medical and Rural Health Services should first identify the overall vacancies in the Medical Institutions under their control. Based on the current level of vacancies, the vacancies available in Medical Institution nearby City or Urban area where other medical facilities are easily available be identified and such vacancies need not be notified at present for filling up during counseling, and the posts be kept vacant till the over all vacancy position improves after fresh recruitment of Medical officers/para medical staff.

(xii) Station seniority in the present posting alone will be the criteria for determining the priority for transfer counseling.

(xiii) All criteria meant for priority in counseling as issued in para 3 of the annexure of the G.O.D.No.508 Health, 10-04-2002 be discontinued.

(xiv) Existing as well as resultant vacancies for counseling / date for counseling shall be made available on the web-site and also in the Notice boards of the Medical Institutions.

(xv) Vacancies of the posts wherein the incumbent is on leave for more than 2 months and as well as vacancies that will be filled by promotion during the next quarter will also be notified for counseling.

(xvi) Outcome of the counseling shall be determined and exhibited (except the cases where the Government is the transferring authority) on the same day itself.

(xvii) Medical Officers with Post Graduate / diploma qualification / super specialities shall not be considered for posting in ESI Dispensaries. Those already working in such dispensaries shall be moved to Government. Hospitals where their services are required in a phased manner.

ORDER :

1. In the Government order first read above, a Committee was constituted to look into mishaps occurring during Professional duties of Doctors working in government and Private Hospitals and to submit a report suggesting the guidelines and measures to be adopted by government in respect of litigations in Court arising out of the mishaps. In the Government order second read above, Thiru. Justice M.Maruthamuthu, retired High Court Judge, was appointed as Chairman of the Committee.

2. The Committee which looked into the above issues in detail submitted its report to the Government on 31.01.2002. The Government have examined ¾ the recommendations of the Committee and pass the following orders to adopt the procedure whenever litigations arise due to the mishps that occur during the Medical/Surgical Treatment given by Doctors in Government Hospitals/Private Nursing Homes/ Hospitals.

I. To follow the existing procedure of allowing the Police registering the complaint under section 304 (a) I.P.C., and investigate.

II. To permit an officer of the rank of Deputy Superintendent of Police or Asst. Commissioner of Police to do the investigation.

III. To issue Departmental instructions for., not to arrest Doctors, as a matter of routine and to effect arrest only when it is legally justified and with the Consultaion of Senior Police Officers.

IV. To Create a Corpus Fund from the contribution of Rs. 10/- p.m. from every Doctor.

V. To make the Government Doctors, to Pay Compensation awarded, by Court in the Court first and then to apply for the refund of amount paid in the Court by Doctors from the Corpus Fund, thus created.

VI. To frame certain guidelines for the regulation of nature of cases eligible for re-imbursement from Corpus Fund and for administration of Corpus Fund.

VII. To Consider the creation of Corpus Fund as a trial measure only and to revise the subscription of Corpus Fund depending upon the functioning of this scheme after one year.

3. The Director-General of Police is requested to follow the procedures mentioned in the items (i), (ii)&(iii) in the paragraph 2 above, whenever occurrence of such cases take place in the Government Medical Institutions/Private Nursing Homes / Hospitals.

4. The Director of Medical and Rural Health Services is requested to take necessary action on the items mentioned in the paragraph 2(iv);(v);(vi) and (vii) above in the Government Medical Institutions.
